The duty to manage
asbestos is yours.
If you own, occupy, manage or maintain non-domestic premises, Regulation 4 of the Control of Asbestos Regulations 2012 places a legal duty on you. Here's what it means - in plain English.

Who is the duty holder?
The duty falls on whoever has responsibility for the maintenance or repair of non-domestic premises - through a tenancy agreement, contract, or simply by being in control of the building. In many cases it's the owner; in others it's the occupier or the managing agent.
If there's no explicit agreement, the duty sits with whoever controls the premises. Often it's shared - and shared duties still need coordinating. If you're not sure whether the duty is yours, that uncertainty is exactly the risk worth resolving.
What the law requires
Four things every duty holder must do.
The duty isn't met by a single survey. It's an ongoing cycle of finding, assessing, planning and keeping current.

- 02 Assess the risk it poses to anyone who could be exposed.
- 03 Make and record a plan to manage that risk.
- 04 Keep the information current and share it with anyone who could disturb it.
Why it matters
The risk is real - and so is the responsibility.
Asbestos remains the single greatest cause of work-related deaths in the UK. The regulations exist because the materials are still present in a huge proportion of buildings constructed before the year 2000 - and they're only dangerous when disturbed by people who didn't know they were there.
Failing to manage that risk isn't just dangerous; it's a breach of law that can lead to enforcement action and prosecution. Managing it well is straightforward when you have the right partner.
